Consultation to Find "loopholes" in Zero-Hour Contract Law

A consultation has been launched this week to investigate the best way of proceeding to eradicate the problem of exclusivity clauses in zero hour contracts.

The consultation was launched by Business Secretary, Vince Cable who is asking businesses, unions and individuals to come forward with suggestions on identifying and how best to close potential ‘loopholes’ in the government plan to get rid of exclusivity clauses in zero hours contracts.

The consultation seeks to find out ways in which employers could get round the ban, for example by creating 1 hour contracts. The government wants to prevent this kind of behavior undermining the law.

The consultation will discover the public opinion on the government taking preemptive action to prevent this. Proposals from the government include civil penalties that could be sought by the worker if they are treated unfairly when found to have taken up other employment when under a zero hour contract.

Business Secretary, Vince Cable said:

“We are tightening the screws on rogue employers who try to abuse workers on zero hours contracts. We are looking closely at any potential loopholes that could arise from a ban, to ensure that these are closed off and no one can get round the new law.”
